Schedule 10 - Approvals relating to Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012

A “marine consent” means a consent that would be otherwise be applied for under the Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012 (EEZ Act). 

Information requirements: referral application 

In addition to general information requirements in the Act, referral applications for approvals relating to the EEZ Act must include: ea4c405d-e74d-441a-89b5-68bf86de89eb  

  • Information about whether the Minister of Conservation is an affected person;
  • Additional information about whether the applicant has already made an application for a consent under the EEZ in relation to the project
  • Additional information about compliance or enforcement action taken against the applicant by the EPA under the EEZ Act.

Information requirements: substantive application

In addition to general information requirements in the Act, substantive applications for approvals relating to the EEZ Act must include: 4520b961-5448-4098-b08d-90be9bfdd7b1

  •   A description of the activity
  •  An impact assessment prepared in accordance with the EEZ Act and any requirements prescribe in regulations made under that Act.
  • If the application relates to an activity referred to in the EEZ Act,  such as the construction, placement, extension, alteration or removal of a structure or a submarine pipeline on or under the seabed, or a  submarine cable on or from the seabed, a description of how and when it is proposed that the structure, submarine pipeline or submarine cable will be dealt with at the end of its life. 

The Panel’s decision

When considering an application for a marine consent, the panel must take into account: 4056a6f7-2723-4ecb-8cc0-58c0ecda9797

  • The purpose of the Fast Track Approvals Act, which is to facilitate the delivery of infrastructure and development projects with significant regional or national benefits
  • The purpose and principles of the EEZ Act and the implementation of international obligations set out under various international conventions
  • Any relevant policy statements issued under the EEZ Act; and
  • Sections 59, 60, 61(1)(b) and (c) and (2) to (5), 62(1A) and (2), 62 and 64 to 67 of the EEZ Act

When considering all the above, the panel must give the greatest weight to the purpose of the Act.

Conditions

The panel may impose conditions set out under sections 63 to 67 of the EEZ Act, as if references to a marine consent authority were references to the panel. 

Status of marine consents

A marine consent that is granted under the Act has the same force and effects for its duration and according to its terms and conditions, as if it were granted under the EEZ Act.
