What is the effect of an enforcement order?
A failure to comply with an enforcement order is an offence. 1095 A person committing this offence is subject to up to two years imprisonment or a fine up to $300,000. 1096 Other entities may be subject to a fine up to $600,000. In addition, the Environment Court can authorise any person to comply with the order, on behalf of the person who has failed to comply, and recover costs against that person.
