Who decides on notification?
Councils decide whether or not a resource consent application will be notified. The decision on notification must be made within 20 working days of a resource consent being lodged (or 10 working days for a fast-track application). If the council decides to notify the application, then notification must be undertaken within this same period. 803
The decision of a council is final and cannot be appealed to the Environment Court. It can only be challenged by judicial review in the High Court.
